VAKS appointed an additional examination in the case of assigning UAH 9.6 million in damages to “Ukrzaliznytsia”

The higher anti-corruption court has appointed an additional comprehensive forensic, economic and commodity expertise in the case involving Oleg Zolotaryov, the former acting head of the “South-Western Railway” branch of PJSC “Ukrzaliznytsia”. He is accused of causing losses to the enterprise in the amount of UAH 9.6 million.

The VAX adopted the relevant decision on September 4, partially satisfying the request of the SAP prosecutor. Appointment of additional expertise became necessary due to conflicting results of research conducted by the prosecution and defense parties.

As part of the court decision, it was stated that a complex forensic economic and commodity expert examination should be carried out to clarify the circumstances of the case.

The case against Zolotaryov was referred to the court after an investigation, which established that in 2017 “Ukrzaliznytsia” announced a tender for the purchase of power devices for passenger cars. Zolotaryov, as the head of the branch, allegedly established a requirement for bidders to provide confirmation of approval of product drawings from Ukrzaliznytsia itself, which became a barrier for many bidders.

Two companies — LLC “Brovarske Elektrotechnichne Obedenia” and LLC “Elpo Ukraine” — received this approval, and other participants were excluded from participation in the auction. This allowed the “selected” companies to win and sell the products of “Ukrzaliznytsia” at inflated prices, which led to losses in the amount of UAH 9.6 million. In September 2021, Zolotaryov was remanded in custody in connection with these charges.
