The day before, it became known that Ihor Kolomoiskyi will remain in custody, despite the fact that in one of the cases, his preventive measure was changed from detention to bail in the amount of UAH 1.877 billion. Kolomoiskyi himself stated that he could not pay such a deposit. However, even if he had been able to pay these amounts, this would not have freed him, as there is another suspicion, on which the preventive measure in the form of detention remains unchanged. Prosecutor Serhiy Deminchuk noted that the change of preventive measure related to a specific criminal proceeding, and the amount of bail was set at the request of the senior detective of the Main Detective Division of the Bureau of Economic Security of Ukraine. It amounts to UAH 1,877,360,000.
The term of this preventive measure expires on September 2, 2024, and Kolomoiskyi’s lawyer asked the court for his release after that date. However, as Deminchuk noted, there is another decision of the investigating judge of the Pechersk District Court, according to which the detention was extended within the framework of another criminal proceeding. This means that Kolomoiskyi will remain in custody.
The businessman’s lawyer, Vyacheslav Kryglevych, in a comment for “Suspilny” emphasized that according to the Criminal Procedure Code of Ukraine, his client should be released from custody, but due to other proceedings, the court cannot release him. In this case, Kolomoisky will be held in custody at least until October 25.
“We categorically disagree with any decisions taken against our client. We will appeal them and seek the full acquittal of Ihor Valeriyovych in all incriminated cases.”Kolomoiskyi’s lawyer stressed.
However, already in the afternoon of August 29, the Shevchenkivskiy District Court of Kyiv granted the request of the prosecutor to change the preventive measure against Ihor Kolomoisky from detention to bail in the amount of UAH 1,877,360,000. About this reported in court
The change of preventive measure was justified by the detective in the petition in accordance with the requirements of part 3 of Article 197 of the Criminal Procedure Code of Ukraine, which stipulates that the maximum term of detention during pre-trial investigation in cases of serious and especially serious crimes should not exceed 12 months.
“As the maximum period of detention within the scope of this criminal proceeding expires on September 2, 2024, we consider it necessary to change the preventive measure. The risks established by the previous decisions of the investigating judges are still relevant, in particular the risk of hiding from the investigation and the court.”, – said the prosecutor during the meeting.
Thus, the court made a decision to post bail in the amount of almost 1.88 billion hryvnias, which became the basis for Kolomoiskyi’s release from custody.
