AMCU has started proceedings against the 5 largest pharmacy chains

The Antimonopoly Committee of Ukraine started consideration of the case against 155 business entities that are part of the five largest pharmacy chains on the market retail trade of medicines. They are suspected of committing anti-competitive concerted actions that may lead to restriction, elimination or prevention of competition, which falls under clause 1 of Art. 50 and Part 1 of Art. 6 of the Law of Ukraine “On the Protection of Economic Competition”.

According to the AMCU, as of July 2025, the ANC Pharmacy, Good Day Pharmacy, 9-1-1 Pharmacy, Podorozhnyk Pharmacy, and We Wish You Health Pharmacy chains together controlled 64% of retail sales and held 42% of the country’s pharmacy outlets, which is 7,742 objects This indicator testifies to their significant market power and ability to influence the terms of sale of goods.

AMCU materials indicate that since February 2025, there has been a reduction in the sales of drugs from three Ukrainian manufacturers in the TOP-5 pharmacy chains. At the same time, the demand for these drugs remained stable, and the decrease in their consumption occurred mainly due to a decrease in their availability at pharmacy points.

Thus, the actions of pharmacy chains, aimed at restricting the sale of domestically produced drugs, can be considered as anti-competitive and affecting the market structure. Such violations are subject to liability in accordance with current legislation.
