Ukrainian business supported the appointment of Tsyvinsky as head of BEB

The Ukrainian Business Council (URB), which unites 124 business associations from various sectors of the economy, welcomed the appointment of the new head of the Bureau of Economic Security (BEB), Oleksandr Tsyvinskyi, who was chosen based on the results of an open competition. About this it is said in a statement published by URB on its website.

“The appointment of the head of the BEB is extremely important for business. The formation of a modern analytical and law enforcement body capable of effectively combating economic crime, while ensuring a reduction in pressure on honest business and protecting the economic interests of the state is key to the recovery and development of the economy.” – stated in the message.

The business community believes that the first task of the new head should be a complete reboot of the Bureau, in particular, re-certification of all personnel.

URB also published a list of key performance indicators (KPIs), which, according to business, should indicate the success of the BEB reform:

  • the ratio between the number of open pre-trial investigations and the number of indictments submitted to court;
  • the ratio of the number of indictments handed over to the courts of first and second instance with the number of convictions in cases investigated by the BEB;
  • the dynamics of stopped criminal proceedings;
  • the share of compensated damages within criminal proceedings and the average amount in each of them;
  • the average duration of the pre-trial investigation, as well as the share of proceedings lasting more than 18 months (Article 219 of the Criminal Code of Ukraine);
  • changes in the number of applied special confiscations and measures against legal entities;
  • in cases under Art. 212 of the Criminal Code — the ratio between the number of sentences and the termination of cases under part 4 of this article (in connection with the voluntary payment of taxes);
  • the dynamics of property seizures, their cost and comparison with similar indicators in neighboring countries, as well as the share of canceled seizures;
  • the number of searches (invasive investigative actions), their effectiveness and comparison with the practice of developed neighboring countries;
  • the ratio between the number of cases entered into the ERDR and the sentences that have entered into force, as well as the number of suspicions issued by the BEB, in comparison with the sentences;
  • the number of business complaints to the business ombudsman in quarterly dynamics.

The URB emphasized that Ukrainian business is determined to constructively interact with the new leadership of the Security Intelligence Service in order to realize the potential of this body as an effective defender of the state’s economy and a safeguard against abuse in business relations with the law enforcement system.
