Donald Trump signed an executive order on criminal prosecution for desecration of the US flag
US President Donald Trump has signed an executive order that provides for criminal and administrative prosecution for burning or other actions that desecrate the American flag. The document obliges federal authorities to apply existing laws to the maximum extent possible to prosecute violators. The text of the decree is published on the White House website.
In it, Trump called the American flag “the most sacred and revered symbol of the United States,” representing the country’s freedom, identity and strength. He emphasized that burning the flag is “offensive and provocative” an act capable of inciting violence and unrest and is often used by foreign groups to intimidate Americans.
“My Administration will act to restore the respect and sanctity of the American Flag and prosecute those who incite violence or otherwise violate our laws by desecrating this symbol of our country, to the fullest extent permitted by any existing authority, Trump said.
According to the order, the U.S. Attorney General must ensure the priority and maximum enforcement of criminal and civil laws against acts of desecration of the flag, particularly if they involve violence, hate crimes, damage to property, or public disorder.
In cases where such actions are subject to state or local laws, cases should be referred to them. The Attorney General may also initiate legal proceedings to clarify exceptions to the application of the First Amendment to the US Constitution in this area.
In addition, the Secretary of State, the Attorney General, and the Secretary of Homeland Security have been given the power to deny visas, revoke visas, residence permits, cancel naturalization procedures or other immigration benefits, and initiate deportation of aliens if they participate in flag violations.
