Due to the lack of judges, the Constitutional Court may cease to function in early 2025

At the beginning of 2025, the Constitutional Court of Ukraine may face the possibility of temporarily suspending its activities due to the lack of a quorum for decision-making.

KSU judge Viktor Horodovenko announced that the term of office of three judges of the Constitutional Court will expire in January 2025. If the available vacancies are not filled in time, the court will not be able to perform its functions.

If the vacancies of judges are not filled in time, the Court will not be able to perform its constitutional functions. This is already a serious challenge that we must overcome“, Horodovenko noted during the “Ukraine’s Path to the EU” conference.

In particular, at the end of January, the 9-year terms of office of judges of the KSU, appointed by the Congress of Judges — Viktor Krivenko, and the President — Volodymyr Moysyk and Viktor Kolisnyk, expire. All three were appointed on January 27, 2016.

After the end of their term of office, only 11 judges will remain in the KSU out of the 18 provided by law, which is not enough for the quorum of 12 judges required to conduct constitutional proceedings.

On October 23, the Advisory Group of Experts, which deals with the preliminary selection of candidates for the Supreme Judicial Council under the quota of the Congress of Judges, completed interviews with nine applicants, but the decision on their suitability has not yet been made. haven’t even started yet.
