Hungary sued the EU Council over the use of frozen assets of the Russian Federation to aid Ukraine
The Hungarian government filed a lawsuit at the Court of Justice of the European Union against the Council of the EU, challenging the use of frozen Russian assets to finance aid to Ukraine. The relevant document published on the website of the Court of Justice of the EU.
Hungary opposes the decision of the Council of the European Union, which provides for the transfer of revenues from frozen Russian assets to Ukraine through the European Peace Fund. This fund was created in 2023 to finance activities within the framework of the EU’s common foreign and security policy, in particular in the military and defense spheres. It provides support to Ukraine, Moldova, Bosnia and Herzegovina and other countries.
The fund reimburses member states for the costs of assistance to Ukraine. Funds are formed at the expense of contributions from EU countries, as well as revenues from frozen Russian assets, which was established by the decision of the Council of the European Union.
Hungary demands the annulment of the decision of the Council of the EU dated May 21, 2024 on the distribution of auxiliary measures for the military support of the Armed Forces of Ukraine, which provided for the use of income from Russian assets through the European Peace Fund. During the adoption of this decision, Hungary abstained from voting.
In addition, Budapest is challenging the European Peace Fund’s March 2025 decision to use revenues from Russian assets to finance military aid to Ukraine. The Hungarian side insists that its abstention during the vote in the Council of the EU cannot be considered as actual support for the allocation of funds for Ukraine through this fund.
