In Ukraine, administrative responsibility for failure to appear at a court summons has been strengthened
The Verkhovna Rada adopted draft law No. 11387 as a whole, which strengthens administrative responsibility for failure to appear at a court summons, as well as for officials ignoring a parliamentary summons. As reported People’s Deputy Yaroslav Zheleznyak, the document was supported by 229 parliamentarians.
“My amendments were adopted in it, which establish administrative responsibility for non-appearance of all persons (and especially government officials) without valid reasons” when summoned by the parliament, – noted Yaroslav Zheleznyak.
The law amends the Code of Ukraine on Administrative Offenses, the Criminal and Criminal Procedure Codes. In particular, an increased amount of fines is established for the suspect, accused, witness or victim who, without good reason, did not appear at the summons of the court — the amount can reach UAH 12,000.
The document also obliges the court to raise the issue of disciplinary liability of the prosecutor or lawyer who did not appear at the meeting before the relevant bodies — the KDKP and the KDKA.
In addition, the law strengthens the responsibility of officials who do not appear at the request of the Verkhovna Rada at meetings of temporary investigative commissions or at plenary meetings. According to the document, non-appearance at the summons of the parliament, committees or TSK entails a fine in the amount of 2,500 to 3,500 tax-free minimum incomes of citizens. In case of repeated violation during the year, a fine of 3,500 to 4,000 such minimums will be imposed.
