The Ministry of Energy has eliminated legal uncertainty regarding the operation of gas supply systems
Ministry of Energy of Ukraine eliminated legal uncertainty that existed in the field of providing services for the technical operation of gas supply systems, ensuring the stable functioning of this market.
In accordance with the Law of Ukraine “On the Natural Gas Market” and Resolution No. 1 of the Cabinet of Ministers of January 3, 2024, which regulates the optimization of the activities of state oversight bodies in the gas industry, the Ministry of Energy issued Order No. 402 of October 21, 2024 “On Approval of the Rules for the Technical Operation of Gas Supply Systems.” The document entered into force on February 20, 2025 and normalized the technical operation of gas systems, which is of particular importance for domestic consumers.
During the preparation of the order, the comments of the interested bodies were taken into account, in particular, regarding the mandatory availability of service provider companies with their own information and communication system (ICS) with protection in accordance with the requirements of SC3I. This is a prerequisite for obtaining a conclusion on the company’s compliance with the requirements for the provision of maintenance services for smoke and ventilation ducts in residential, public and communal facilities.
After the entry into force of the Law of Ukraine No. 4336-IX dated March 27, 2025 “On Amendments to Certain Laws of Ukraine Regarding Information Protection and Cybersecurity of State Information Resources, Critical Information Infrastructure Objects”, there was a need to revise and adapt secondary legislation. The State Intelligence Service is currently working on the preparation of relevant acts of the Government.
Since the absence of such regulatory acts hinders the work of enterprises servicing ventilation and smoke ducts, the Ministry of Energy has amended Order No. 402, which allows to avoid legal uncertainty and ensure the continuity of services in the field of operation of gas supply systems.
After the approval of the relevant government documents prepared by the State Special Intelligence Service, Order No. 402 will be brought into full compliance with the new regulatory and legal acts. The Ministry also emphasizes that the digitalization of this area makes it possible to solve the problem of fictitious examination reports, which were previously issued without control and caused tragic incidents among the population.
