The SBI informed about the suspicion of the judge of the Commercial Court of Dnipropetrovsk region, who ordered the kidnapping of his business partner (video)
The sanction of the article for this crime is punishable by imprisonment for a term of up to 5 years.
Based on the materials of the State Bureau of Investigation (SBI), the Deputy Prosecutor General reported the suspicion to one of the judges of the Commercial Court of Dnipropetrovsk Region. The judge is accused of ordering the kidnapping of a partner to solve his business affairs, informs website of the department.
In 2017, the judge decided to engage in entrepreneurial activities in addition to his main job. Since judges are not allowed to do business, he found a cover person for whom he issued all the permits. The judge was interested in the agricultural sector, so his partner registered an agricultural enterprise in the Sumy Region. To start the business, the judge allocated more than UAH 3 million, for which combine harvesters, trucks, tractors and other equipment were purchased. The judge received most of the profit, while his partner had a much smaller income for managing the enterprise.
In order to protect himself from possible provocations by his partner, the judge forced him to conclude a fictitious loan agreement for UAH 5 million, allegedly borrowed by the judge’s roommate.
Over time, the enterprise expanded, and the suspect’s partner also invested money in its development. However, the judge became less and less satisfied with the management of the partner and decided to remove him from the business, blackmailing him with a million dollar loan. When the partner refused to withdraw from the cases without pay, the judge decided to influence the situation physically.
The judge ordered representatives of the criminal environment to kidnap the partner for $17,000. The partner had to be deprived of his freedom and forced to sign the necessary documents for the transfer of ownership of the company’s property.
The illegal actions of the judge were documented by law enforcement officers. The judge is suspected of organizing a completed attempt to kidnap a person and deprive him of liberty, committed for selfish reasons, based on a prior conspiracy by a group of persons, which was carried out over a long period of time (Part 2 of Article 15, Part 3 of Article 27, Part 2 of Article 146 Criminal Code of Ukraine).
The sanction of the article provides for punishment in the form of deprivation of liberty for a term of up to 5 years. Currently, the issue of choosing a preventive measure in the form of round-the-clock house arrest is being resolved. Procedural management is carried out by the Prosecutor General’s Office.
