Ukraine plans to start compulsory acquisition of land for fortifications

The Cabinet of Ministers of Ukraine approved the draft law, which provides for the forced temporary deprivation of the right to use land plots for the period of martial law for the construction and maintenance of engineering and technical and fortification structures. The draft law proposes amendments to the Land Code of Ukraine and other laws regulating the legal regime of martial law and procedures for forced seizure of property. The main purpose of the changes is to create legal grounds for temporarily seizing land plots or parts of them that are in private ownership for the purpose of placing defense structures on them.

According to the innovations, land owners and users may be temporarily deprived of the right to use their land during martial law. This decision will be accompanied by the drawing up of relevant acts and may provide for the further purchase or forced alienation of the site, if the need for its use remains relevant.

The draft law also defines the procedure for making decisions regarding the termination of the temporary seizure of plots or their purchase. The government has previously announced full funding for the construction of the fortifications, but details of the timing and plans remain classified.

It should be noted that the Mykolaiv region was the first to complete the construction of fortifications, becoming an example for other regions in strengthening defense infrastructure.
