Ukrainian refugees in Germany: how to switch from Paragraph 24 to a residence permit

Since the start of the full-scale war, thousands of Ukrainians have found refuge in Germany, which provides temporary protection under Paragraph 24 of the Residence Act. However, many are already thinking about the long-term perspective — obtaining a permanent residence permit (residence permit) or citizenship. The temporary protection is valid until March 4, 2025, but its further extension remains in question, especially against the background of political changes in Germany. This forces many to look for alternative ways of legalization.

How to switch from Paragraph 24 to a residence permit

Ukrainians have several options for transitioning from temporary protection to residence permit. The main condition for any of these options is financial independence. That is, the applicant must cover his own expenses without the support of social services such as Jobcenter or Sozialamt. In addition, the migration service checks the absence of criminal records.

It is important to remember that after the Paragraph is changed, it is not possible to return to temporary protection.

Options for obtaining a residence permit in Germany

1. EU Blue Card (Paragraph 18g)

This type of permit is suitable for highly qualified professionals. Basic requirements:

Availability of a job offer lasting at least six months.

The job must match the applicant’s qualifications.

The annual income must be at least 45,300 euros gross (data for 2024).

The advantage of the Blue Card is the ability to get permanent residence faster. It also automatically includes the applicant’s family in the passport.

2. Certificate for highly qualified workers (Sections 18a, 18b, 19c)

This option is suitable for specialists with qualifications recognized in Germany:

Paragraphs 18a and 18b: Require proof of qualifications and offer of employment in regulated or unregulated occupations.

Paragraph 19c: Aimed at professionals with substantial work experience and an annual income of €40,770 or more.

3. Student visa (Paragraph 16b)

To obtain a permit, you need:

Be enrolled in an educational institution in Germany.

To speak German at the B2 level or higher.

Have a blocked account with an amount of at least 11,208 euros per year to provide accommodation.

4. Visa for self-employed persons (Paragraph 21)

This option is suitable for entrepreneurs and freelancers. Basic requirements:

Providing a business plan that confirms the viability of the project.

Financial support of entrepreneurial activity.

If necessary, the presence of a professional license.

5. Reunification with the family

For Ukrainians who have relatives in Germany, a residence permit is possible through family reunification. Conditions:

The applicant must be a close relative (husband/wife, minor children, guardians).

In some cases, reunification with other family members is possible, but this is a more difficult process.

What documents are required to change the status

The main list of documents includes:

  • Valid passport.
  • Proof of financial independence (employment contract, business documents or bank account).
  • Qualification confirmation (diplomas, certificates).
  • Insurance.
  • Additional documents depending on the selected paragraph.

Risks and nuances

A transition from Paragraph 24 to another status is final. Returning to temporary protection will not be possible.

There are strict requirements for each paragraph, and failure to meet at least one of them may result in rejection.

The Migration Service may request additional information, such as proof of language proficiency or no criminal record.

Why you should act now

The temporary protection has a fixed period of validity and its continuation remains in question. In connection with political changes in Germany, the conditions of stay of refugees may become more complicated. Processing a residence permit application takes time, so it is important to start the process early.

Obtaining a residence permit in Germany is a step towards stability and integration into European society. The options offered for Ukrainians allow you to choose the most convenient way for a long-term stay.
