Court acquits MP Nikolaenko, who beat to death 18-year-old girl
The Zhytomyr District Court acquitted the People’s Deputy from “Batkivshchyna” Andriy Nikolayenko in the case of a road accident in which an 18-year-old girl died in 2023. This became known from the sentence of the court.
The court established that on November 3, 2023, Nikolayenko was driving along the Kyiv-Chop highway at a speed of 141 kilometers per hour. This exceeded the maximum speed limit on this section of the road.
The verdict states that the girl who died in the accident began to cross the road “in an unforeseen place.” The court also indicated that if Nikolayenko had driven at the permitted speed of 110 km/h and braked in time, the accident could have been avoided.
Nikolayenko was charged under Part 2 of Article 286 of the Criminal Code of Ukraine. He pleaded not guilty. The court heard witnesses, as well as investigators who reviewed the video from surveillance cameras, after which it found the deputy not guilty of committing a fatal road accident and acquitted him.
“The circumstances of the actions of the pedestrian, who suddenly ran out onto the road in a prohibited place, created a danger to the driver’s movement (clause 1.10 of the Traffic Rules),” the court decision states.
On November 3, 2023, the driver of a Mercedes-Benz GLE was driving in the direction of Chop in the far left lane and hit a pedestrian. As a result of the accident, an 18-year-old girl died on the spot.
The car was driven by the People’s Deputy from “Batkivshchyna” Andriy Nikolayenko. He himself confirmed his involvement in the accident. The People’s Deputy stated that he was sober, did not violate the rules, “but the tragedy could not be avoided.” He also assured that he would assist the SBI’s investigative actions and would voluntarily undergo all necessary examinations.
“A great tragedy has occurred, which can no longer be undone or undone. True despair is when you can’t influence the situation in any way. My sincere condolences to the family. I don’t know what else to say…”, — he wrote on Facebook.
Law enforcement officers informed Nikolayenko of suspicion of violation of traffic safety rules by the person driving the vehicle, which led to the death of the victim under Part 2 of Article 286 of the Criminal Code of Ukraine. Subsequently, he was placed under 24-hour house arrest, and later the preventive measure was changed to personal obligation.
