The Cabinet of Ministers approved a new procedure for automating the issuance of subpoenas
The Cabinet of Ministers of Ukraine adopted a new procedure for automating the issuance of summonses, which provides for centralized printing, the launch of data exchange between registers, and the official recognition of sending summonses by mail as legally equivalent to personal delivery. This was reported by People’s Deputy Oleksandr Fedienko.
Among the key changes defined by the resolution is the possibility of centralized printing of summonses not only by territorial procurement centers, but also by the Ministry of Defense, regional TCCs and state printing enterprises of strategic importance. An automatic exchange of information between the registers is also being introduced, which allows the formation of summons based on the data of military records and other electronic resources without the use of paper media.
In addition, the possibility of sending summonses by registered mail through “Ukrposhta” or other authorized postal operator. For this purpose, the TCC and the Ministry of Defense will enter into appropriate agreements with the postal services.
“It used to be considered an auxiliary mechanism, and lawyers could prove in court that a person did not receive a letter. Now a letter through the post is equated with official delivery. That is, a clear legislative mechanism has been introduced, which makes it possible to make mass mailings and makes it impossible to avoid delivery through the mail, Fedienko explained.
