The Antimonopoly Committee is investigating the case against “Karpatska Dzherelna”: what caused it

Water under this trademark has no connection with the Carpathians, as its extraction and packaging are carried out hundreds of kilometers from this region.

The Antimonopoly Committee of Ukraine (AMCU) has launched an investigation against the water producer “Karpatska Dzherelna” due to suspicion of misleading consumers. About this reported AMCU press service.

The Department has started consideration of case No. 127-26.4/116-24 regarding LLC “Carpathian Mineral Waters” on grounds of violation of Article 15-1 of the Law of Ukraine “On Protection from Unfair Competition”, which provides for the dissemination of misleading information.

“The subject of the case is the actions of Carpathian Mineral Water LLC regarding the distribution of information about the water of the Karpatska Dzherelna brand, in particular, regarding its origin and characteristics,” the AMCU notes.

AMCU draws attention to the fact that “Karpatska Dzherelna” is extracted from wells, not springs, and its extraction and packaging are carried out hundreds of kilometers from the Carpathians. Therefore, the name “spring” and the reference to the Carpathians can be misleading for consumers.

In the absence of proper confirmation of such information, the actions of LLC “Carpathian Mineral Waters” contain signs of a violation provided for in Article 15-1 of the Law of Ukraine “On Protection from Unfair Competition”, which may mislead consumers about the true origin and characteristics of products.

“Carpathian mineral waters” is a national producer of mineral waters and soft drinks with over 15 years of experience. The company began its activity in 1996 with the first bottling of mineral natural table water under the brand “Karpatska Dzherelna”. In 2002, the company was reorganized into a factory for the production of mineral water and soft drinks “Carpathian mineral waters”.

In 2002, the company expanded its range, starting the production of sweet carbonated drinks under the “Fruktova Dzherelna” and “Sokovinka” brands, and in 2016 – an energy drink under the “Dragon” brand.

Today, “Carpathian mineral waters” is a significant player on the Ukrainian market of natural mineral waters and soft drinks. “Karpatska Dzherelna” mineral water is extracted from two artesian wells with a depth of 90 meters. According to the company, the production is located directly next to the wells, and the water enters the bottling line through the pipeline, passing only filtration from mechanical impurities, preserving all useful natural trace elements.
