The Court of Appeal upheld the decision to recover 1.22 billion hryvnias from the former owner of PJSC “VB Bank” Oleg Bakhmatya in favor of the NBU

The Kyiv Court of Appeal considered the appeal of the former owner of PJSC “VB Bank” Oleg Bakhmatyuk and left unchanged the decision of the court of first instance to recover UAH 1.221 billion from him in favor of the National Bank of Ukraine to repay the debt under the stabilization loan.

“The Court of Appeal confirmed the legality of the National Bank’s requirements and the decision of the court of first instance, which has now entered into legal force and is binding on the bank’s guarantor. Ensuring the inevitability of fulfilling obligations is a key element of financial discipline and stability of legal relations, said Serhiy Boyko, Head of the Department of Legal and Judicial Work with Problem Assets of the Legal Department of the National Bank of Ukraine.

In 2014, PJSC “VB Bank” concluded an agreement with the National Bank on a stabilization loan in the amount of UAH 1.2 billion. Oleg Bakhmatyuk acted as a guarantor for the bank’s return of these funds, signing a surety agreement with the NBU, assuming personal obligations to repay the financial institution’s debt.

Since neither the bank nor its guarantor fulfilled their obligations, in 2015 the National Bank filed a lawsuit to collect the debt. On January 30, 2025, the Pechersky District Court of Kyiv satisfied the National Bank’s claim against Oleg Bakhmatyuk, making a decision to recover UAH 1.221 billion in favor of the state regulator.

Currently, the Pechersky District Court of Kyiv continues to consider five more cases on the National Bank’s claims against Oleg Bakhmatyuk related to the debts of PJSC “VB Bank” and PJSC “CB “Financial Initiative”. The total amount of debt that the NBU is trying to recover from the businessman in court is about UAH 7.9 billion.
