Verkhovna Rada bans transplantation of organs of fallen soldiers
The Verkhovna Rada adopted in the second reading and as a whole draft law No. 9558, which prohibits the removal of organs for transplantation from fallen soldiers, as well as from persons who died as a result of armed aggression against Ukraine. The explanatory note states that the purpose of the draft law is to improve, develop and harmonize legislation in the field of transplantation, as well as to improve the provision of medical care with the use of transplantation.
The current legislation of Ukraine already contains a ban on the removal of organs from cadaver donors who died as a result of an anti-terrorist operation or during the performance of tasks related to ensuring national security and defense, repelling the armed aggression of the Russian Federation. However, this ban does not apply to Donetsk and Luhansk regions.
Therefore, there was a need to clarify the legislative norms that regulate the prohibition of the removal of anatomical materials for transplantation or the manufacture of bio-implants from military personnel, law enforcement officers or other employees of military formations, units, units, institutions or organizations created in accordance with the laws of Ukraine.
This applies to persons who died while performing official duties due to injuries received as a result of hostilities in Ukraine or in the territories where the legal regime of martial law operates, in accordance with the provisions of the Law of Ukraine “On the Legal Regime of Martial Law”.
