A law has entered into force in Ukraine canceling the suspension of the statute of limitations for the period of martial law
The Verkhovna Rada adopted this document on May 14, President of Ukraine Volodymyr Zelenskyi signed it on June 2, and already on June 3 the law was officially published in the newspaper “Holos Ukrainy”.
The adopted law cancels the suspension of the statute of limitations for the period of martial law – the corresponding item 19 in the section “Final and transitional provisions” The Civil Code is excluded. The law is designed to guarantee legal certainty and protect defendants from late claims, as well as restore a fair balance between the rights of plaintiffs and defendants. In the version effective from March 19, 2022, clause 19 provided for the extension of the statute of limitations for the entire period of martial law in Ukraine.
“Since the judicial system is functioning, citizens already have the opportunity to go to court to protect their rights. And in some cases – for example, the participation of a person in hostilities – the court, as before, will be able to renew the deadline, if valid reasons for its omission are established”, explained in the press service of the Verkhovna Rada.
