Communities will not be able to use the DPT for new construction

From January 1, 2025, a ban on the use of detailed area plans (DPT) for new construction came into force in Ukraine. From now on, the allocation of land plots for development is possible only on the basis of the spatial development plan or the current master plan. About this reported head of the Verkhovna Rada Committee on State Power Organization, Local Self-Government, Regional Development and Urban Planning, Olena Shulyak.

“Unscrupulous developers, in collusion with the local authorities, pushed the DPT, which “specified” the master plan in such a way that it directly contradicted it. In the future, it was on the basis of such DPT that the purpose of the land plots, which were set aside for development, was determined and the relevant permission documents were obtained.” Shulyak noted.

The deputy emphasized that since January 1, the possibility of using the old mechanisms for changing the purpose of land use has become unavailable due to the entry into force of Law No. 711 “On Amendments to Certain Legislative Acts of Ukraine Regarding Land Use Planning.”

From now on, in order to change the purpose of a site or allocate land for community development, a comprehensive spatial development plan, which must be approved in each community, or an up-to-date general plan of the settlement must be guided.

“The new document is at the same time urban planning documentation at the local level and land management documentation”, Shulyak explained.

A comprehensive spatial development plan covers the entire territory of the community, including the suburbs, and provides for clear functional zoning, for example, residential development or industrial zones. It has no expiration date, but can be renewed annually. Implementation of the law is currently complicated by the fact that many communities do not yet have an approved spatial development plan.
